1 General

This is the FileBox Acceptable Use Policy, hereby referred as Acceptable Use Policy.

FileBox is one of the affiliated websites of the Compass Security Network Computing AG (CSNC), a Swiss corporation with its registered address at Werkstrasse 20, CH-8640 Rapperswil, Switzerland. Referred to as CSNC in the following.

2 Terms of Use

Please read this Terms of Use agreement (the "Acceptable Use Policy") carefully before accessing or participation in any upload, download, registration, website visit, transaction, or other form.

3 Applicability

By using and participating in the Site, you acknowledge that you have read the FileBox Acceptable Use Policy, the CSNC Terms of Use (https://www.compass-security.com/en/legal/terms-of-use), and the CSNC Privacy Policy (https://www.compass-security.com/en/legal/privacy-policy) during user registration and agree that Acceptable Use Policy, CSNC Terms of Use, and the CSNC Privacy Policy constitute a binding legal agreement between you and CSNC, and that you agree to be bound by and comply with the FileBox Acceptable Use Policy, the CSNC Terms of Use as well as the Privacy Policy.

If you do not agree to be bound by the Acceptable Use Policy, Terms of Use or the Privacy Policy, you will not be able to access the Site.

4 User Accounts

In order to fully participate in all Site activities, you may be required to provide personal data, mainly an email address and a phone number for second factor authentication, for either:

• The creation of a personal account on the Site (Registration)
• The upload of files or data for a registered user on the Site (FastUpload)
• The access of files or data provided to you by a registered user (FastDownload)

You may be prompted or required to enter additional information, as defined in the Privacy Policy accepted during user registration. You represent that all information provided by you is accurate, current and complete and you agree that you will maintain and update your information to keep it accurate, current and complete.

You acknowledge that if any information provided by you is wrong, false, inaccurate, not current or incomplete, we reserve the right to terminate your use of the Sites.

User accounts and the associated data may be automatically deleted after one year of inactivity.

To request removal of your personal information from FileBox, contact us at privacy(at)compass-security.com.

5 Age Restrictions

Registration and participation on the Sites is restricted to those individuals over 16 years of age, emancipated minors or those who possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties herein. By registering or participating in services or functions on the Sites, you hereby represent that you are over 16 years of age, an emancipated minor or in possession of consent by a legal parent or guardian and have the authority to enter the terms herein. In any case, you affirm that you are over the age of 16 as the Site is not intended for children under 16. If you are under 16 years of age, do not use the Sites. In addition, those who wish to register and participate must meet the minimum requirements laid out in the Terms of Use (this document) and abide by the Code of Ethic herein. In addition, certain Courses may have additional eligibility requirements, as specified on the Course website. If you do not qualify or do not agree to these terms, you may not use the Site.

6 Right of Modification

We reserve the right to change or modify Terms of Use and the Privacy Policy at our sole discretion at any time. Any change or modification to the Terms of Use will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Sites after publication of such modifications, with or without notification, constitutes binding acceptance of these modified Terms of Use.

7 Rules of Use

You agree to use the Sites in accordance with all applicable laws. You further agree that you will not e-mail or post or upload any of the following content ("Prohibited Content") anywhere on the Site, or on any other CSNC computing resources:

• Content that defames, harasses, or threatens others.
• Content that discusses illegal activities with the intent to commit such activities or encourages others to commit such activities.
• Content that infringes or misappropriates another's intellectual property rights, including, but not limited to, copyrights, trademarks, or trade secrets.
• Content that infringes the rights of others, including publishing, sharing, or storing information without authorization
• Content that you do not have the right to disclose under contractual confidentiality obligations or fiduciary duties.
• Material that contains obscene (i. e. pornographic) language or images Advertising, promotional materials, or any form of commercial solicitation.
• Content that otherwise harms other users or visitors to the Site including but not exclusive to Malware, Spyware, Adware.
• Content that is otherwise unlawful or that violates any applicable local, state, national or international law.
• CSNC Lab reserves the right to remove Prohibited Content of which it becomes aware but is under no obligation to do so.

Copyrighted material, including without limitation software, graphics, text, photographs, sound, video and musical recordings, may not be placed on the Site without the express permission of the owner of the copyright in the material, or other legal entitlement to use the material.

In addition, as a condition of accessing the Sites, you agree not to

• scan, or test the vulnerability of the site and systems, unless done in compliance with our Bug Bounty Program;
• reproduce, duplicate, copy, sell, resell or exploit any portion of the Sites other than as expressly allowed under these Terms of Use;
• use FileBoxs or CSNC Institutions name, trademarks, systems in connection with any unsolicited communications, promotions, advertisements, or spam;
• use any high-volume, automated means to access the Sites (including without limitation, robots, spiders, scripts or web-scraping tools);
• frame the Sites, place pop-up windows over its pages or otherwise affect the display of its page;
• disrupt the Sites, systems or networks connected to the Sites.

You agree to notify CSNC immediately at infosec(at)compass-security.com in case you gain unauthorized access to any data or resources.

Finally, you agree that you will not access or attempt to access any other users account otherwise circumvent any security or authentication measures or misrepresent or attempt to misrepresent your identity while using the Sites.

8 User Content

The FileBox solution is a file sharing solution, as such files, emails or links may be user generated and are largely beyond the control of CSNC. Access, download and the use any files, links, emails or resources found on or originating from FileBox is at the User's own risk. CSNC assumes no responsibility for the suitability, accuracy, completeness, adequacy, legality, or otherwise of the contents or for any offers and services contained therein.

Furthermore, as FileBox is a sharing solution, it is not intended as a file storage solution. Users are responsible to backup and protect their files on their own. CSNC takes no responsibility for the loss of files and data.

CSNC reserves the right to delete and fully remove any data or files without prior notification or providing reasoning.

9 Limited Liability

To the maximum extent permitted by applicable law, CSNC and its affiliates shall not be liable for loss or damage of any kind (including but not limited to loss of profit, loss of use, loss of data or information, or any direct, indirect, incidental or consequential damages) suffered by the User or any other party in connection with or arising out of the use of or access to CSNC’s websites, or information or content contained therein regardless of the factual grounds or legal basis of such loss or damage, including but not limited to contract, tort (including negligence), indemnity, warranty, strict liability or otherwise. CSNC does not warrant that the CSNC websites run flawlessly and CSNC accepts no liability for any interference with the User's IT system through viruses, hackers, or malware of any type.

10 Privacy Policy

You understand that any personal information you submit to FileBox will be treated by CSNC according to the Privacy Policy accepted upon user registration. The processing of the personal data on CSNC *.compass-security.com and *.csnc.ch sites that you submit and that we collect, and the procedures we apply for analyzing the use of the CSNC websites, are further described in the Privacy Policy which can be accessed by using the following link: https://www.compass-security.com/en/legal/terms-of-use

These Terms of Use shall be subject to and construed in accordance with Swiss law.

The exclusive place of jurisdiction for disputes arising is Rapperswil-Jona, Canton of St Gallen (Switzerland).
